French Parliament Approves 31.4% Tax on Stable Coin Trades

With the French government’s approval of a 31.4% tax on stablecoin trades to be enforced from January 1, 2027, France’s crypto market may well be reconfigured, putting up fresh obstacles for investors and altering the way they trade.

New Tax Rules for Crypto-to-Stablecoin Swaps

Parliament has approved an amendment to the 2027 budget which will levy a 31.4% tax on profits made from swapping cryptocurrencies for stablecoins. Under the terms of the legislation, any transaction involving the exchange of a crypto asset for a stablecoin deemed an ‘electronic money token’ by European regulators will be subject to the tax.

Until now, an investor in France could make such an exchange without incurring an immediate tax liability and could defer capital gains; the new law eliminates that. A swap for stablecoins is now a taxable event and the 31.4% rate must be paid on any gains made.

Supporters and Critics React to the Tax on Stablecoin Trades

Supporters of the law argue that stablecoins have come to function as traditional money and that one should not be able to sidestep taxes by moving funds into them. By taxing these trades, lawmakers aim to close what they see as a loophole.

However, critics argue that the end of tax deferral will dampen some of the enthusiasm for crypto trading in the country. As the CryptoWendyO channel has noted, there are concerns that this will drive investors to offshore or decentralized venues where regulation and taxation are more difficult to enforce, to the detriment of France’s standing in the digital asset space.

Broader Implications for Crypto Regulation in Europe and Beyond

France has been at the forefront of cryptocurrency regulation in Europe and by being so explicit about the tax on stablecoins, it may establish a precedent for others to follow, in line with global norms. The flat 31.4% rate is a very straightforward approach and could influence policy debates elsewhere. It is already the case in the U.S. that such an exchange is taxable, though the rates depend on the holding period and other factors.
