Russian Central Bank Considers Blocking USDT and Heavy Fines

The Russian Central Bank is in talks about levying fines as high as 40% and blocking USDT, all in an effort to crack down on crypto arbitrageurs. Should they proceed, the way Russians do business with stablecoins will be altered, and the legal ramifications could be severe.

Central Bank’s Concerns and Proposed Measures

The regulator is paying particular attention to the source of funds for USDT purchases, especially when the transaction involves Kyrgyzstan or Belarus as the counterparty. On a Pro Blockchain Media Live broadcast, the issue was raised: the regulator may decide to deny local users any access to USDT at all. There are also proposals to fine anyone found engaging in crypto arbitrage by 20-40% of the transaction amount.

Legal experts on the show pointed out that under Russian law, these actions are tantamount to illegal currency operations, and one does not need a large USDT deal to incur a heavy penalty; it is a sign of stricter regulatory enforcement.

Arbitrage Profits and Legal Risks

Until now, price differentials of 2% or more on P2P exchanges have made USDT arbitrage profitable for many Russians who buy in Kyrgyzstan or Belarus to sell back home. But lawyers on Pro Blockchain Media Live cautioned that the new measures will turn even a small operation into a legal quagmire, making it an increasingly unviable proposition. The Central Bank is intent on clamping down on easy arbitrage and imposing financial discipline, and with the prospect of a 40% fine and increased scrutiny, the risks are higher than ever.

Upcoming Regulatory Changes and Alternatives

There is also the upcoming ban on July 1, 2023, on acquiring crypto from unlicensed intermediaries, which targets non-qualified investors. This regulatory change will restrict legal access to such assets for many retail users.

For some in Russia and the EU, commentators believe that DeFi might be the only recourse. As centralized alternatives grow riskier, these platforms present a safer option, though they are not immune to regulatory scrutiny in the future.
