CFTC Proposes New Rules for Retail Crypto Trading with Leverage

With the publication of a draft regulation on leveraged retail crypto trading, the CFTC is making it possible for crypto exchanges to come under federal supervision. In what is being seen as a key development for a single national framework to govern digital assets, the Commodity Futures Trading Commission has put forward a proposal that would for the first time allow the formation of new exchanges for this purpose.

A New Era for Regulated Crypto Exchanges

As reported in a recent CoinDesk broadcast, the CFTC’s move is a response to the jurisdictional ambiguities of the past that have largely precluded any form of federal oversight. Under the terms of the draft, an exchange can choose to be part of a national regulatory regime and thereby avoid having to contend with the patchwork of state money transmission laws, which are a source of difficulty for operators in the industry.

Industry Reaction and Motivations

Speaking to CoinDesk, Michael Pasolacca of the CFTC chair’s senior advisory staff made it clear that exchanges will be inclined to take up the opportunity to be regulated by a single federal agency. For the crypto sector, he sees the prospect of not having to deal with state-level red tape as a catalyst for growth and innovation.

As for the proposal, the CFTC is seeking public comment to finalize the rules with input from the broader community and industry stakeholders. It is all part of an effort to establish a sound regulatory foundation suited to the needs of the market.

Broader Regulatory Ambitions: AI and On-Chain Finance

The CFTC is signaling a regulatory agenda that goes well beyond leveraged retail crypto trading. In recognition of how quickly the digital asset sphere has adopted technologies such as artificial intelligence, the agency intends to establish frameworks for on-chain financial systems and AI as well.

A forum will be held by the CFTC on agent-based finance and AI to assist with this; among the topics to be discussed are issues of legal liability and accountability, in line with the agency’s proactive approach to the risks and opportunities involved. And as for advancing crypto regulation, CFTC chair Mike Selig has made clear the agency is prepared to do so, especially after the recent passage of the Clarity Act.
